These Terms and Conditions ("Agreement") govern the booking and use of travel services
provided by Pavel Alter Inc., doing business as Roots Travel ("we,""us", "our"). By making
a booking with us, you ("Customer" or "you") agree to be bound by these terms.
1. Introduction
Roots Travel is a travel agency and tour operator based in New York State, providing
customized travel arrangements and guided tours. These Terms and Conditions apply to all
services, including but not limited to tours, transportation, accommodations, and any other
travel-related arrangements booked through us.
2. Booking and Payment
● Booking Process: Bookings can be made via our website, by email, phone, or in
person at our office. Your booking is considered confirmed when you receive a
written confirmation from us.
● Payment:
○ A deposit of [X]% of the total booking cost is required at the time of booking.
○ Full payment is due [X] days before the departure date unless otherwise
specified.
○ Payment can be made by credit card, debit card, bank transfer, or other
methods specified at the time of booking.
● Currency: All prices are quoted in U.S. Dollars (USD). Any applicable taxes or fees
will be outlined at the time of booking.
3. Cancellation Policy
● Customer Cancellations:
○ Cancellations made more than [30] days before departure: Full refund minus
a cancellation fee of [$X] or [X]% of the total trip cost.
○ Cancellations made between [30-15] days before departure: [X]% of the total
trip cost is non-refundable.
○ Cancellations made less than [15] days before departure: No refund.
● Note: Some third-party service providers (e.g., airlines, hotels, or specialized tour
providers) may have stricter cancellation policies. We will inform you of any third-
party terms at the time of booking.
● Cancellation by Roots Travel:
○ We reserve the right to cancel or modify your booking if necessary due to
insufficient bookings, unforeseen circumstances, or events beyond our
control. In the event we cancel your trip, we will offer:
■ A full refund, or
■ An alternative tour or travel arrangement of equal value, subject to
availability.
○ We will notify you as soon as possible if a cancellation occurs.
● No Show / Failure to Travel: If you fail to show up for your trip or do not use all of
the services booked, no refund will be provided.
4. Changes to Bookings
● Customer Requests for Changes:
○ If you wish to make changes to your booking (e.g., date changes, participant
details), please notify us as soon as possible. We will do our best to
accommodate your requests; however, changes are subject to availability and
may incur additional fees.
○ Change Fee: A fee of [$X] may apply for changes made after confirmation,
plus any costs imposed by third-party service providers.
● Company Changes to Bookings:
○ We reserve the right to make changes to the travel itinerary, accommodation,
or other services if necessary. In case of major changes, we will notify you in
advance and offer an alternative or refund for the affected portion of the trip.
5. Liability Disclaimer
● Acting as Intermediary: Roots Travel acts as an intermediary between you and the
third-party service providers, including airlines, hotels, transportation companies, and
local tour operators. We do not assume responsibility for any direct actions or
omissions of these third parties.
● Force Majeure: We are not liable for any delays, cancellations, or disruptions caused
by circumstances beyond our control, including but not limited to acts of nature (e.g.,
weather, earthquakes, pandemics), terrorism, government restrictions, strikes, or
other unforeseen events.
● Limitations of Liability:
○ Roots Travel is not liable for any loss, injury, or damage to you, your property,
or your travel companions while participating in any tour or travel
arrangement. This includes, but is not limited to, injuries or illnesses
sustained while traveling, loss of luggage, or theft.
○ Our total liability for any claims arising out of our services is limited to the total
amount paid for the affected service.
● Health and Safety:
○ Customers are responsible for ensuring they are in good health and able to
participate in the booked travel arrangements. If you have any pre-existing
medical conditions or special needs, please inform us at the time of booking.
We may require a doctor's note or further information if deemed necessary for
your safety.
○ Roots Travel cannot be held liable for any injuries, accidents, or health issues
that may arise during travel.
6. Travel Insurance
We highly recommend that you purchase travel insurance to protect against trip
cancellations, interruptions, medical emergencies, lost luggage, and other unforeseen
circumstances. Travel insurance is not included in the cost of the booking but can be
arranged through our office or your insurance provider.
7. Travel Documents and Requirements
● Passports and Visas: You are responsible for ensuring you have the appropriate
travel documents, including a valid passport, visa (if required), and any health
certifications necessary for your destination.
● Vaccinations and Health Requirements: It is your responsibility to be aware of any
vaccination or health requirements for your destination and to comply with them.
Roots Travel is not liable for any travel issues arising from incomplete or incorrect
travel documentation.
8. Special Requests and Accessibility
● Special Needs: If you have any special needs, including dietary restrictions, mobility
issues, or other requests, please inform us at the time of booking. We will make
reasonable efforts to accommodate you; however, we cannot guarantee availability
of specific accommodations.
● Group Travel: For groups with specific requirements (e.g., family, senior groups,
etc.), additional terms may apply. Please contact us directly for more information.
9. Privacy and Data Protection
Roots Travel respects your privacy and will not share your personal data with third parties
except as required to complete your booking (e.g., with airlines, hotels, insurance providers).
Your data will only be used for booking purposes and to provide updates about your travel
arrangements.

10. Governing Law and Dispute Resolution
● Governing Law: This Agreement shall be governed by and construed in accordance
with the laws of the State of New York, without regard to its conflicts of law principles.
● Arbitration: Any dispute, claim, or controversy arising out of or relating to this
Agreement shall be resolved through binding arbitration in New York County, New
York, under the rules of the American Arbitration Association.
11. Miscellaneous Provisions
● Severability: If any provision of these Terms and Conditions is deemed to be invalid,
illegal, or unenforceable, the remainder of the agreement shall continue in full force
and effect.
● Amendments: Roots Travel reserves the right to amend these Terms and
Conditions at any time. You will be notified of any significant changes, and continued
use of our services will constitute acceptance of the revised Terms and Conditions.
● Entire Agreement: These Terms and Conditions constitute the entire agreement
between you and Roots Travel, superseding all prior agreements or understandings.

Cancellation Policy
Customer Cancellations:
